When all issues in a family law case are agreed upon by the parties, it is called a non-contested or uncontested matter.
NonCon Jon can only represent one party in a family law case. However, filings can be done on behalf of both parties (assuming the other party is not represented – see below for information regarding hiring legal counsel) and any unrepresented party is free to speak to the team at NonCon Jon in order to get information (but not legal advice).
Missouri has a mandatory “cooling off” period for thirty days following the filing of the initial documents with the court during which a judgment cannot be entered. The team at NonCon Jon will work to have the final documents ready and filed within 45 days from filing the initial documents with the court. Typically, once filed with the court, the final documents and judgment will be signed within 5-7 business days.
NonCon Jon will handle your family law case in the following Missouri counties: Ste. Genevieve, St. Francois, Washington, Jefferson, Franklin, St. Louis County, St. Louis City, and St. Charles.
Any changes that are requested will be included in the paperwork, so long as that is done prior to filing the final documents with the court.
Typically, a non-contested matter can be submitted to the court “on affidavit,” meaning the parties each sign a sworn affidavit to file with the court with the final documents verifying agreement to the final settlement. This typically avoids the need to appear in court.
Every party to every action is free to hire their own lawyer. If the party chooses to hire their own lawyer, it will not affect the fees for NonCon Jon as long as the parties remain in agreement.
If the parties choose they no longer want the divorce, modification, or paternity action, the matter can be dismissed. No further action will be taken. Any money spent to that point will be billed, with the remainder being refunded.
Once you pay, you will receive a packet of documents that includes a lawyer/client fee agreement, statements of income, expenses, property, and debt, and information for the parties (including children, if applicable). This lets the team at NonCon Jon start the process of drafting paperwork to file with the court. Additionally, we will require deeds and titles for all titled property that is subject to divorce proceedings. All paperwork can be sent and received electronically for your convenience.
